On February 14, 2025, the FMCSA extended the period for the public to comment on the FMCSA’s proposed rules regarding “broker transparency.” The comment period is reopened for 30 days – and the proposed rule can be found at this link.
The proposed rules address issues related to freight brokers’ shipment and payment records and the provision of those records to motor carriers, specifically:
Brokers must keep records in electronic format.
Contents of brokers’ records, for each shipment, must include all charges and payments, date, description, and any claims.
Broker must provide records to carriers upon request.
Broker must provide records to carriers within 48 hours of request.
The FMCSA’s regulation of freight brokers is a critical issue for the transportation industry. Any interested parties should submit a comment on or before March 17, 2025.
